			<content:encoded><![CDATA[<p>A total of 242 players turned out for the $5,000 Main Event of the <strong>Wynn Classic</strong> and when the smoke cleared, poker pro <strong>Brandon Cantu</strong> stood tall above the field for $363,000. He defeated poker veteran <strong>Jared Jaffee</strong> heads-up.</p>
<p>The win resulted in 1,152 <strong>CardPlayer Player of the Year</strong> points for the young gun, who explained that despite the major victory, his prospects of winning the annual award were not helped tremendously: “I thought I was going to get more than 1,100 points. It didn’t do that much to help me. For some reason, it doesn’t have the feel as it would if you won a <a href="http://www.pokernewsdaily.com/articles/wpt/" title="WPT">WPT</a> event or a bracelet, but it feels great financially.” Cantu sits in 40th in CardPlayer’s Player of the Year race.</p>
<p>Jaffee is fresh off a fourth place finish in the <a href="http://www.pokernewsdaily.com/articles/wpt/" title="World Poker Tour">World Poker Tour</a>’s (WPT) Southern Poker Classic in January for $135,000 and collected $246,000 by virtue of taking second in the Wynn Classic Main Event this week. On the heads-up play, Cantu told <a href="http://poker.prosportsonline.net"title="" >Poker News</a> Daily, “It was pretty short. When we got down to heads-up, he was down 5:1 in chips and I had a hand the first 10 hands. He didn’t have much of a chance. For some reason, I knew I was going to win. It had nothing to do with the player, but I had been catching lots of cards and cold decking people the whole tournament. It all worked out really well.”</p>
<p>The Wynn Classic Main Event lacked the television coverage that a WPT or <a href="http://www.pokernewsdaily.com/articles/wsop/" title="World Series of Poker">World Series of Poker</a> (<a href="http://www.pokernewsdaily.com/articles/wsop/" title="WSOP">WSOP</a>) major final table might receive. However, the crop of high-stakes pros that turned out impressed Cantu: “It got a really good turnout and people were taking it really seriously. I don’t think the Wynn did a very good job of publicizing it. They didn’t let poker media outlets know or I think they’d have gotten a lot more players. It used to be a $10,000 tournament, but they lowered it to $5,000.” In celebration of his win, Cantu plans to take some well-deserved time off.</p>
<p>Cantu is a card-carrying member of Team UB.com and, as such, has been touched by the <a href="http://poker.prosportsonline.net"title="" >online poker</a> site’s decision to axe the 2010 <strong>Aruba Poker Classic</strong>, a longtime staple of its annual schedule. Cantu explained his disappointment with the tournament’s cancellation: “I am a little bummed. It’s actually my favorite tournament of the year from the standpoint of the nice beaches. You can’t beat where it is. UB took good care of their pros and the people who came.”</p>
<p>The 2010 <strong>WSOP Tournament of Champions</strong> has dominated poker news headlines this week as bracelet winners jockey for votes to be among the 20 participants selected by the general public. Cantu is a two-time bracelet winner and told Poker News Daily how he feels about the poker all-star game concept: “I hate lobbying for stuff like that, but I guess it’s a good idea. It’s kind of like an NBA All-Star Game ballot. It would make for really good television too.”</p>
<p>Cantu had traveled to Montreal for a bachelor party when he sat down with Poker News Daily, but still had visions of the Wynn Classic Main Event dancing in his head. In particular, tournament officials told Cantu and company that the event would likely span four days due to extra levels added in. However, Cantu had plans to travel to Canada on March 18th, one day after the third scheduled day of play, and so took it upon himself to ensure the event ended quickly. Cantu was a one-man wrecking crew down the stretch. Here’s how the final table shook out in the 2010 Wynn Classic Main Event:</p>

             Behind a busy table in the back of the bar, posters track the progress of South Dakota&#8217;s high school basketball tournaments.<br /> Above the table, both high school and college games flash on television screens. And the topic of conversation is, predictably, hoops — as well as gambling.<br /> As visitors discuss the day&#8217;s games, they also talk money, curious about who is favored to win and by how many points. Bets and cash get sealed into white envelopes, which get tucked neatly into a small box on top of the table.<br /> Nearby, a man writes in a small notebook, cash is openly exchanged, and talk continues about wagers and spreads.<br /> Locals say gambling has been going on for years at The Circus Sports Bar and Grill — or at least it was until late Friday afternoon, when the police, after being questioned by the American News, shut the betting down.<br /> &#8220;We went in there and had some folks place some bets,&#8221; Police Chief Don Lanpher Jr. said. &#8220;After they placed bets, uniforms went in and told them it&#8217;s illegal.&#8221;<br /> Interviews were conducted, and names of some of the major players — the owner, two men sitting at the table and a few others — were taken, Lanpher said. The information now will be transferred to the Brown County State&#8217;s Attorney&#8217;s Office. <br /> Lanpher said the owner, Lonnie Frost, was told the gambling had to stop. Frost could face possible charges as well as a revocation of his liquor license.<br /> Betting on sporting events — high school, college, professional — is illegal in South Dakota. So is operating an establishment that allows wagering. Either infraction is a misdemeanor punishable by as much as 30 days in county jail and a $500 fine.<br /> Officers will be making trips through the bar throughout the weekend to make sure The Circus is complying, Lanpher said. He said patrons were betting on both college and high school tournaments.<br /> When reached Friday night, Frost said he had no comment. When he was asked if there have been bookies in The Circus, he replied, &#8220;not to my knowledge.&#8221;<br /> While police responded to The Circus on Friday afternoon, there are rumors that there could be betting at other bars.<br /> During six visits to The Circus since March 11, American News employees witnessed bets being taken and wagers being discussed but only in the past two days; the high school boys&#8217; tournament started Thursday. Most patrons in the bar during the visits this week were males, many of them middle-age. Some customers confirmed that it is widely known that bets can be placed at the bar. Another basketball fan said it&#8217;s not difficult to learn what the point spreads on boys&#8217; high school tournament games are in Aberdeen.<br /> Kimberly Dorsett, Brown County state&#8217;s attorney, said Friday morning she had heard complaints in recent days about local betting on high school basketball. She said she shared the information with local law enforcement but had not heard back as of the time she left town Friday morning. Early Friday afternoon, Lanpher said his department had yet to hear about the complaints. He seemed surprised to hear about the gambling allegations. A few hours later, the department sent in undercover individuals.<br /> Before Friday, Lanpher said there hadn&#8217;t been an investigation into sports gambling in his five-plus years in Aberdeen. A few longtime officers with the department said they didn&#8217;t recall any investigations, either.<br /> Bob VanWinkle, a counselor with the Lutheran Social Services in Aberdeen, said it&#8217;s easy for bettors to find action in town anytime. But, he said, there&#8217;s a spike in betting for major sporting events — the NCAA men&#8217;s basketball tournament, Super Bowl, World Series, major horse races, etc.<br /> &#8220;All you have to do is ask a few questions, and people will hook you up with the bookies here in town,&#8221; he said.<br /> VanWinkle did not cite any specific business but spoke about a generic way in which a bet might be placed locally.<br /> Most betting is more localized and doesn&#8217;t involved bookies who take a cut of bets, he said. Instead, it&#8217;s among individuals, sometimes friends and sometimes people who have never met. A person who wants to place such a bet generally knows where to do so and might, for example, leave an envelope that includes money and point spread information. Sometimes, another person picks up that envelope. If not, the person gets his or her money back, he said.<br /> Wayne Carney, executive director of the South Dakota High School Activities Association, said he didn&#8217;t know betting on high school games was happening in Aberdeen.<br />  “It&#8217;s news to me,” he said. “But obviously I don&#8217;t live in Aberdeen. And I&#8217;m not in Aberdeen.”<br />   SDHSAA Assistant Executive Director Jo Auch is in Aberdeen this weekend for the State B, and she wasn&#8217;t aware of the gambling either, Carney said. Carney is spending the weekend in Sioux Falls, where the State Class A boys&#8217; tournament is taking place.<br />  Carney doesn&#8217;t think that “betting on any kind of athletic contest makes any sense at all.”<br />  But he&#8217;s heard of betting on South Dakota high school tournaments in years past.<br /> “This is nothing new,” he said.<br /> When Carney was coaching at Hamlin in the late 1970s and early &#8217;80s, “it was no secret that there was a bar here in Sioux Falls” where there was “money passed on high school games.”  <br />  Some Hamlin fans told him bets were placed at the Sioux Falls bar during tournament games.<br /> “I can&#8217;t confirm that. I never went there,” Carney said. “I&#8217;m just going by what I was told by some of our fans, and I think it was pretty well known if you were in town for the Class B tournament, that&#8217;s where all the action was.”<br /> Carney has never heard of anyone betting on high school football playoffs.<br /> “Football&#8217;s a whole different animal,” he said. “You come in for one game, you pack up and you go home.”<br /> For basketball tournaments, people visit a city for three days. In football, fans often don&#8217;t stay overnight.<br /> “Does that mean there isn&#8217;t any (gambling)?” he said. “I don&#8217;t know. I&#8217;ve never heard of any. But then I&#8217;ve never heard of anybody betting on the B tournament in Aberdeen either till you just told me.”  <br />  Carney said if the betting is being done on high school games, “that obviously needs to be stopped. That&#8217;s not what we&#8217;re about.”<br />  Less overt gambling — office basketball and football pools — is also illegal. While popular at many workplaces and among friends, Dorsett said complaints about such pools had not been filed with her office.<br /> Tom Schmitt, chief deputy sheriff for Brown County, said the bulk of businesses in town likely have some type of NCAA bracket pool. It would be difficult and time-consuming to police them all, he said.<br /> Some types of sports gambling offered by nonprofits are legal, Dorsett said. For example, local groups sell books for the NCAA Final Four and NFL season in which winners, determined by the number of points teams combine to score, receive cash. Such fundraisers are legal provided the proper application is sought and granted ahead of time, Dorsett said.<br /> A variety of other types of gambling, ranging from video lottery to Deadwood gaming to betting on live <a href="http://horses.prosportsonline.net"title="" >horse racing</a>, are legal in South Dakota.<br /> Dorsett said there&#8217;s a misconception that betting on sports via the Internet is legal. It is not. South Dakota&#8217;s law can punish both people who place bets over the Internet and those who operate such Web sites, she said. The crime is a felony punishable by as much two years in state prison and a $4,000 fine. A subsequent offense is punishable by as much as five years in state prison and a $10,000 fine.

<h3 align="CENTER">MEMORANDUM FINDINGS OF FACT AND OPINION</h3>
<p>COHEN, Judge.</p>
<p>Respondent determined deficiencies of $9,580.40 and $47,944.76 in petitioners&#8217; Federal income taxes for 2004 and 2005, respectively. For 2004, respondent determined an addition to tax of $2,089.35 under section 6651(a)(1) and an amount to be determined under section 6651(a)(2). Respondent also determined accuracy-related penalties of $1,916 and $7,493.59 under section 6662 for 2004 and 2005, respectively. All section references are to the Internal Revenue Code in effect for the years in issue, and all Rule references are to the Tax Court Rules of Practice and Procedure.</p>
<p>After concessions, the issues for decision are whether petitioners are entitled to reduce rental income and capital gains by amounts not conceded by respondent; whether petitioner Esther K. Chow was a professional gambler, entitling her to deduct fully her gambling losses against gambling income on Schedule C, Profit or Loss From Business, as business losses or whether those losses are deductible only on Schedule A, Itemized Deductions, as itemized deductions; whether petitioners are liable for additions to tax under section 6651(a) for late filing of their 2004 Federal income tax return; and whether petitioners are liable for penalties under section 6662(a) with respect to their 2004 and 2005 returns.</p>
<h3 align="CENTER">FINDINGS OF FACT</h3>
<p>Some of the facts have been stipulated, and the stipulated facts are incorporated in our findings by this reference. Petitioners resided in San Gabriel, California, at the time that they filed their petition.</p>
<p>Petitioner John F. Chow (Dr. Chow) is a retired physician. Petitioner Esther K. Chow (petitioner) studied as a medical laboratory technician. From 1974 through 1994, petitioners operated a medical practice. They built a medical office and pharmacy on property on Del Mar Avenue in Rosemead, California. In 2004 and 2005, petitioners&#8217; income consisted of rental income, gains from sales of real property, and Social Security benefits.</p>
<p>Petitioners&#8217; rental property included residential property on Lilac Place in Los Angeles and, before its sale in 2005, the Del Mar Avenue property. They incurred various expenses, including legal expenses, relating to the rental property. During 2005, they incurred expenses of $25 paid to the Department of Water and Power and $70.20 paid to the Department of Building and Safety with respect to the Lilac Place property.</p>
<p>The Del Mar Avenue property was sold in 2005 for $970,000. At that time, petitioners paid $51,760 to secure release of a lien recorded against the property by their former attorney, Kenneth Hopp. Hopp had represented petitioners in relation to a civil rights action against San Bernardino County, California. The lien was filed after Hopp secured a judgment against petitioners.</p>

<p>Also at the time the Del Mar Avenue property was sold, petitioners paid $25,000 to Dr. Chow&#8217;s sister and her husband in repayment of a loan.</p>
<p>About 1987, petitioner began gambling. After Dr. Chow underwent surgery in 2003, petitioner began playing <a href="http://slotsgalores.com"title="" >slot machines</a> extensively and exclusively at the Morongo Casino in Cabazon, California. She gambled on 124 days in 2004 and 176 days in 2005.</p>
<p>In 2004, petitioner won 15 jackpots of $2,000 or more, and in 2005 she won 98 jackpots of $2,000 or more. In 2005, she won two $10,000 jackpots; two $15,000 jackpots; and single jackpots of $13,500, $13,530, $18,750, $19,200, $25,000, and $32,000. In all, she had gambling winnings of $283,072 and gambling losses of $339,832 in 2004. She had gambling winnings of $1,079,292 and gambling losses of $1,232,005 in 2005. If the winnings and losses are calculated on a net basis for each slot machine session in which she played over a period of time and did not take more than a 3-hour break, she had total gambling income of $36,216 and losses of $93,862 in 2004 and income of $231,836 and losses of $383,507 in 2005.</p>
<p>Petitioners did not use a professional preparer to prepare their Federal income tax returns. The first Form 1040, U.S. Individual Income Tax Return, for 2004 received by the Internal Revenue Service (IRS) was signed on October 31, 2006, and received on November 1, 2006. It was labeled &#8220;Amended Return&#8221; but was not on a Form 1040X, Amended U.S. Individual Income Tax Return, prescribed for amended returns. On that return, petitioners deducted on Schedule A $60,350 as gambling losses, which they included in the amount of itemized deductions used to offset their adjusted gross income. They reported no taxable income and no tax due. Copies of 31 Forms W-2G, Certain Gambling Winnings, were attached to the return.</p>
<p>On January 22, 2007, petitioners signed and sent to the IRS a Form 1040X for 2004. They again included $60,350 as gambling losses on Schedule A and deducted them against adjusted gross income. They reported no taxable income and no tax due.</p>
<p>On February 5, 2007, petitioners signed and sent to the IRS another Form 1040X for 2004. On this Form 1040X, petitioner was identified as a &#8220;professional gambler since 1987&#8243;. On a Schedule C, petitioners reported gambling income of $60,360 (the amounts shown on the attached copies of Forms W-2G) and deducted &#8220;cash capital used&#8221; of $88,650, showing a Schedule C loss of $28,540. Although the manner of computation is unclear from this Form 1040X, the reported adjusted gross income was reduced by amounts that included the claimed gambling losses. Petitioners reported no taxable income and no tax due.</p>
<p>Petitioners&#8217; Form 1040 for 2005 was signed by petitioners and sent to the IRS on April 17, 2006. Both petitioners were shown as &#8220;retired&#8221;. On that return, they reported a $607,133 gain from sale of the Del Mar Avenue property. They deducted from adjusted gross income $334,217.90 as gambling losses based on a detailed &#8220;Gambling Statement For 2005&#8243; attached to the return, but they did not include a Schedule C. Among the deductions claimed on Schedule A as miscellaneous deductions were &#8220;loans reimbursements ($25,000 + $53,000)&#8221; totaling $78,000. Again petitioners reported no taxable income and no tax due.</p>
<p>On August 28, 2006, petitioners signed and sent to the IRS a Form 1040 marked &#8220;Amended Return 2005&#8243;. Their occupations were shown as &#8220;retired&#8221;. On Schedule A, petitioners claimed as miscellaneous deductions &#8220;GAMBLING LOSSES: Capital used: $1,054,170 WG forms: $710,543&#8243; and included $710,543 in the total itemized deductions claimed. They also deducted $710,543 from adjusted gross income on the first page of the Form 1040 and reported no taxable income and no tax due.</p>
<p>On February 5, 2007, petitioners signed and sent to the IRS a Form 1040X for 2005. On this Form 1040X, petitioner was shown as a &#8220;professional gambler since 1987 to present&#8221;. A Schedule C was attached and reported a loss of $347,591, which was claimed to reduce adjusted gross income. Petitioners reported $35,764 as taxable income and $4,636 tax due.</p>
<p>Sometime before the Forms 1040X were submitted to the IRS in February 2007, petitioner met with an IRS representative concerning the proper method of reporting petitioners&#8217; income and losses. The use of Schedule C was commenced after discussions with the IRS representative. Sometime before August 3, 2008, (the date of the statutory notice), petitioners&#8217; returns were examined by the IRS. During the course of the examination, bank records, including canceled checks, were delivered to the examining agent. The records were subsequently misplaced and were not available by the time of trial in July 2009.</p>
<h3 align="CENTER">OPINION</h3>
<p>Unfortunately, the parties have expended much effort during the process of this case disputing matters that have no effect on the decision to be entered. Petitioners have from the beginning and through their posttrial briefs chosen to make spurious attacks on respondent&#8217;s agents and counsel and to file motions and requests for relief that have no reasonable basis in fact or in law. Their claims range from deliberate destruction and falsification of records to &#8220;elder abuse&#8221;. We will not detail or address those claims in this opinion because they have no colorable merit and do not affect the resolution of issues properly before the Court.</p>
<p>Notwithstanding the difficulties created by petitioners&#8217; approach to this case, the parties were able to settle substantial issues and to enter into stipulations of many of the controlling facts. Respondent has conceded charitable contribution deductions and some rental expenses that had been disallowed in the statutory notice. Other claimed rental expenses and basis adjustments relating to petitioners&#8217; sale of the Del Mar Avenue property remain in dispute as personal expenses or are unsubstantiated. The most significant issue is classification of petitioner&#8217;s gambling losses as business losses of a professional gambler or losses in an activity not engaged in for profit. If the former, the losses may fully offset the gains reportable on Schedule C. If the losses are only reportable as itemized deductions on Schedule A, the itemized deductions (other than the gambling losses) are subject to reduction pursuant to section 68. The addition to tax for late filing of petitioners&#8217; 2004 return and the accuracy-related penalty for both years also remain in dispute.</p>
<p>As a general rule, taxpayers have the burden of proving that they are entitled to the deductions that they claim. Rule 142(a); <u>New Colonial Ice Co. v. Helvering</u>, 292 U.S. 435, 440 (1934); <u>Rockwell v. Commissioner</u>, 512 F.2d 882, 886 (9th Cir. 1975), affg. T.C. Memo. 1972-133. Under section 7491(a), the burden of proof shifts to respondent if petitioners complied with requirements to substantiate an item, maintained all required records, and presented credible evidence as to a factual issue.</p>
<h3 align="LEFT"><u>Rental Expenses</u></h3>
<p>Petitioners claim expenses in 2004 and 2005 relating to their Lilac Place rental property beyond the amounts allowed in the statutory notice or conceded by respondent. The disputed items for 2004 relate to lawsuits involving petitioners, a real estate broker, and others. Although petitioners have presented partial documents from several lawsuits, they have not presented credible evidence or corroborating evidence that they paid in 2004 the amounts that they claim for that year. They are not entitled to any additional rental deductions for 2004.</p>
<p>For 2005, petitioners presented copies of two money orders for $25 and $70.20 dated in 2005. The money orders appear to be for public services relating to the Lilac Place property. Petitioners are entitled to an additional deduction of $95.20 on Schedule E, Supplemental Income and Loss.</p>
<h3 align="LEFT"><u>Del Mar Avenue Property Adjustments</u></h3>
<p>Petitioners seek to reduce their taxable gain on the sale of the Del Mar Avenue property in 2005 by the amounts used to pay off a judgment obtained by their former attorney and to pay back a loan from relatives. Petitioners originally reported these items as miscellaneous expenses on Schedule A. Respondent contends that the origin of the judgment, i.e., attorney&#8217;s fees incurred in civil rights litigation, was personal.</p>
<p>Petitioners contend that removal of the judgment lien was necessary to &#8220;clear title&#8221; to the Del Mar Avenue property and that Hopp&#8217;s fees were deductible attorney&#8217;s fees. However, respondent is correct that paying a judgment having a personal origin does not increase petitioners&#8217; basis in the property sold and that attorney&#8217;s fees incurred in personal litigation are not otherwise deductible. See generally <u>United States v. Gilmore</u>, 372 U.S. 39, 49 (1963) (holding that the origin and character of the claim with respect to which the expense was incurred, not its consequence to the taxpayer, is controlling in the determination of whether the expense is business or personal). The litigation with petitioners&#8217; former attorney had no relationship to operating, acquiring, or defending title to the Del Mar Avenue property. Payment of the judgment obtained by the attorney was a nondeductible personal expense under section 262 and did not increase petitioners&#8217; basis in the Del Mar Avenue property under section 1016. See <u>Heger v. Commissioner</u>, T.C. Memo. 1993-408, affd. without published opinion 35 F.3d 561 (5th Cir. 1994).</p>
<p>Petitioners claim that they borrowed $25,000 from relatives and repaid the loan at the time the Del Mar Avenue property was sold. On their original Federal income tax return for 2005, they deducted this amount as &#8220;loans reimbursements&#8221; on Schedule A. It was not separately itemized on the schedules attached to the amended returns for 2005. Petitioners have not presented credible evidence that $25,000 was spent on amounts properly added to the basis of the property. They have failed to satisfy their burden of proof or to shift the burden of proof to respondent with respect to this item.</p>
<h3 align="LEFT"><u>Petitioner&#8217;s Gambling Activities</u></h3>
<p>The parties have stipulated petitioner&#8217;s winnings and losses as reflected in the records maintained by the Morongo Casino. Respondent has calculated the losses using a &#8220;session-based analysis&#8221;, i.e., by netting wins and losses per slot machine session, as described in <u>LaPlante v. Commissioner</u>, T.C. Memo. 2009-226. Regardless of the methodology, petitioner&#8217;s losses exceeded her winnings in each year. She is not, however, entitled to deduct those losses against other income, even if we conclude that she is a professional gambler. See sec. 165(d); <u>Boyd v. United States</u>, 762 F.2d 1369, 1372-1373 (9th Cir. 1985); <u>Kochevar v. Commissioner</u>, T.C. Memo. 1995-607.</p>
<p>Petitioners rely on <u>Commissioner v. Groetzinger</u>, 480 U.S. 23 (1987), as similar to petitioner&#8217;s situation and the standard by which she should be determined to be a professional gambler. In <u>Commissioner v. Groetzinger</u>, <u>supra</u> at 35, the Supreme Court held that &#8220;if one&#8217;s gambling activity is pursued full time, in good faith, and with regularity, to the production of income for a livelihood, and is not a mere hobby, it is a trade or business&#8221;. The Supreme Court did not hold, as petitioners contend, that all gamblers are in the trade or business of gambling and that classifying gamblers is improper discrimination. Respondent asserts that the facts of <u>Groetzinger</u> are not similar to those of this case.</p>
<p>Consistent with other cases using the Groetzinger standard, the parties analyze petitioner&#8217;s gambling activities with regard to regulations promulgated under section 183 to identify activities not engaged in for profit. See, e.g., <u>Hastings v.</u> <u>Commissioner</u>, T.C. Memo. 2009-69; <u>Merkin v. Commissioner</u>, T.C. Memo. 2008-146.</p>
<p>Whether the taxpayer engages in an activity with the primary purpose of making a profit is a question of fact to be resolved based on all the facts and circumstances in a particular case. <u>Golanty v. Commissioner</u>, 72 T.C. 411, 426 (1979), affd. without published opinion 647 F.2d 170 (9th Cir. 1981); sec. 1.183-2(a), Income Tax Regs. While the test for whether a taxpayer engaged in an activity with the intention of making a profit takes into account the subjective intention of the taxpayer, greater weight is given to the objective facts than is given to the taxpayer&#8217;s mere statement of intent. See sec. 1.183-2(a), Income Tax Regs.</p>
<p>Section 1.183-2(b), Income Tax Regs., provides a nonexclusive list of relevant factors to be weighed when considering whether a taxpayer is engaged in an activity for profit. The relevant factors are: (1) The manner in which the taxpayer carried on the activity; (2) the expertise of the taxpayer or his advisers; (3) the time and effort expended by the taxpayer in carrying on the activity; (4) the expectation that the assets used in the activity may appreciate in value; (5) the success of the taxpayer in carrying on other activities for profit; (6) the taxpayer&#8217;s history of income or losses with respect to the activity; (7) the amount of occasional profits, if any, that are earned from the activity; (8) the financial status of the taxpayer; and (9) whether elements of personal pleasure or recreation are involved in the activity. No one factor is determinative of whether an activity is engaged in for profit. <u>Brannen v. Commissioner</u>, 722 F.2d 695, 704 (11th Cir. 1984), affg. 78 T.C. 471 (1982); <u>Golanty v. Commissioner</u>, <u>supra</u> at 426; sec. 1.183-2(b), Income Tax Regs. Some of the factors do not apply or are neutral here.</p>
<p>Respondent asserts that petitioner had no business plan, did not seek or follow expert advice, and did not adhere to her alleged pattern of strategic times to gamble. Thus respondent argues that petitioner did not carry on her activities in a businesslike manner and did not use the skills involved in her prior successful activity of managing Dr. Chow&#8217;s medical practice.</p>
<p>Petitioner testified that she had &#8220;on the job&#8221; training as a professional gambler beginning in 1987; that she read a couple of books about slot machine strategy; and that she had reasons for gambling on particular days and during particular hours. The nature of gambling or other high-risk activities makes comparison to businesslike conduct of more traditional businesses difficult. There seem to be no recognizable standards for a businesslike approach to slot machine gambling. Therefore these factors are not conclusive.</p>
<p>The record contains information about petitioner&#8217;s history of profits and losses only for the 2 years in issue. Petitioner received substantial jackpots, but she continued to play until the overall results, whether on a session-by-session basis or an annual basis, were substantial losses. Her gambling and her losses increased from 2004 to 2005, when the substantial proceeds of the sale of the Del Mar Avenue property permitted her to increase the &#8220;capital&#8221; she claims to have invested in the gambling activity. Petitioners, however, were retired, and the record suggests that sale of the Del Mar Avenue property eliminated a substantial source of rental income. Petitioners&#8217; other income would not permit petitioner to sustain such losses indefinitely in the future. Petitioners&#8217; situation is distinguishable from cases respondent cites in which other sources of income allowed a taxpayer to pursue an activity as a hobby, without expectation of profit.</p>
<p>The parties dispute whether petitioner maintained appropriate records of her gambling activities. Petitioners claim that respondent&#8217;s agents are responsible for loss of certain records and that, therefore, respondent cannot show that they did not maintain adequate records. Petitioner did not maintain a logbook, but the casino records of her activities allowed the parties to reconstruct the stipulated amounts of winnings and losses. Cf. <u>Estate of Espinoza v. Commissioner</u>, T.C. Memo. 2005-239. The schedules and Forms W-2G attached to petitioners&#8217; returns were detailed as to dates and amounts. While petitioners&#8217; calculations of deductible losses were erroneous, they appear to be attributable to a misunderstanding of the law rather than to insufficient records.</p>
<p>Respondent acknowledges that petitioner engaged in gambling during 2004 and 2005 with continuity and regularity. It is unclear from her testimony whether she derived pleasure from it, but that factor is generally neutral. See, e.g., <u>Strickland v. Commissioner</u>, T.C. Memo. 2000-309. Petitioner strongly disputes a suggestion by respondent&#8217;s agent that her gambling was &#8220;compulsive&#8221; or &#8220;addictive&#8221;. Her activities appear similar to those in other cases not involving professional gamblers, but there is no evidence from either party sufficient to draw a conclusion about psychological factors. Cf. <u>Gagliardi v. Commissioner</u>, T.C. Memo. 2008-10.</p>
<p>Bearing in mind that the expectation of profit is a matter of subjective intent and need not be reasonable, see sec. 1.183-2(a), Income Tax Regs., we believe that the preponderance of the evidence favors petitioner&#8217;s claim that during 2004 and 2005 she pursued gambling with a profit objective. This is a close case, and petitioners would be prudent to abandon gambling as a potential source of income. We conclude, however, that petitioner was a professional gambler during 2004 and 2005 and may deduct her gambling losses to the extent of her gambling winnings on Schedule C. Of course, she may not deduct any excess losses from petitioners&#8217; adjusted gross income from other sources.</p>
<h3 align="LEFT"><u>Late Filing of 2004 Return</u></h3>
<p>Section 6651(a)(1) provides that, in the case of failure to file a tax return on the date prescribed for filing (including any extension of time for filing), there shall be added to the tax required to be shown on the return an amount equal to 5 percent of that tax for each month or fraction thereof that the failure to file continues, not exceeding 25 percent in the aggregate, unless it is shown that the failure to file timely is due to reasonable cause and not due to willful neglect. Under section 7491(c), respondent has the burden of production and has produced records showing that petitioners&#8217; 2004 return was not received by the IRS until November 2006.</p>
<p>Petitioners claim that they filed a Form 1040 for 2004 on April 10, 2005, and that they always filed their tax returns on time. The document that petitioners claim was their timely Form 1040 dated April 10, 2005, has attached Schedules C and E that are identical to those attached to the Form 1040X sent to the IRS in February 2007; they are not attached to the purported amended return filed in November 2006. Petitioners claim that the attachments were erroneous due to rushing to include the document as an exhibit to the stipulation.</p>
<p>After reviewing the entire history of petitioners&#8217; filings and shifting positions, we cannot accept the testimony concerning a timely filed return for 2004. Because petitioners deny that the return was late, they have not suggested any reasonable cause. Therefore, petitioners are liable for an addition to tax under section 6651(a) on the recomputed deficiency for that year.</p>
<h3 align="LEFT"><u>Section 6662 Accuracy-Related Penalty</u></h3>
<p>Section 6662(a) and (b)(1) and (2) imposes a 20-percent accuracy-related penalty on any underpayment of Federal income tax attributable to a taxpayer&#8217;s negligence or disregard of rules or regulations, or substantial understatement of income tax. Section 6662(c) defines negligence as including any failure to make a reasonable attempt to comply with the provisions of the Internal Revenue Code and defines disregard as any careless, reckless, or intentional disregard. Disregard of rules or regulations is careless if the taxpayer does not exercise reasonable diligence to determine the correctness of a return position that is contrary to the rule or regulation. Sec. 1.6662-3(b)(2), Income Tax Regs.</p>
<p>On each version of their Forms 1040, petitioners attempted to deduct wagering losses against other income, directly contrary to section 165(d). That issue alone justifies application of the penalty to the final recomputed deficiency for each year. Petitioners also claimed deductions that were contrary to section 262 or were not substantiated. They spoke to IRS representatives but obviously rejected or misinterpreted the advice they received. There is no indication that they ever sought independent professional tax return preparation advice or otherwise exercised reasonable diligence to determine the correctness of their returns. As in <u>Umstead v. Commissioner</u>, T.C. Memo. 1982-573, petitioners were negligent in displaying an unwillingness to understand any explanation of the tax laws other than their own misguided notions. Their tendency to use self-help caused problems with their returns and with their conduct of this case, and they are urged to consult competent tax professionals before filing their returns or engaging in litigation in this Court in the future.</p>
<p>Petitioners also claim that there are no penalties due because they owe no tax, but they are wrong about that. The section 6662 penalty will apply to the recomputed deficiency for each year.</p>
<p>We have considered the other arguments of the parties. They are irrelevant, moot, or without merit. To reflect concessions and our conclusions stated above,</p>
<p><u>Decision will be entered under Rule 155</u>.</p>

<p><span lang="EN">Nevada USA is host to many billion dollar casinos and hotels and that investment has been getting more difficult to manage. The stake holders want to protect their holdings from the domino effect should the climate of the economy get even tougher. It has been speculated that the Nevada Gaming Control Board is in the process of creating rules to govern casino operators that have business relationships with online gambling websites. The board members want to be sure that the regulations for online gambling activities are up to date and ready should internet gambling become legal in the USA. As things stand now most casino licensees are unrestricted to have divisions that deal with online gambling. A spokesperson for the board, Randall Sayre, said, &#8220;some gaming licensees play carefully by the rules and others do not,&#8221; he added, &#8220;We don&#8217;t have a policy and clearly the board needs to boil down exactly what the policy needs to be.&#8221; Technically some issues are in a grey zone with things such as the advertising of free <a href="http://casinomovement.com"title="" >online casino</a> sites and the use of the dot net versus dot com mirror sites to attract players. The Nevada Gaming Control Board has to straighten out these difficult to craft rules and policies before the situation becomes uncontrollable.</span></p>

<p><span lang="EN-CA">Advertising itself is a major concern for the rule makers. Land-based casinos have a defined set of guidelines that are strictly adhered to but these rule don&#8217;t necessarily apply to online casinos and gambling. The industry is in a transitional period looking for a base line to make things fair and transparent. Rules and regulations for the gambling industry have kept it from falling prey to unscrupulous operators. Rules for the online sector will keep the industry secure and trouble free. Companies such as Harrahs who have already ventured into the interactive gambling market have not commented but are hopeful that guidelines will be forth coming soon.</span><span lang="EN"></p>

<p>
&#8220;Actually,&#8221;  Harrell confessed, &#8220;it&#8217;s not as exciting as it sounds.&#8221; </p>
<p>
Harrell says his first clue that he&#8217;d entered a professional marriage doomed to failure struck the moment a human resources rep handed him a thick binder filled with the company rules and regulations.
</p>
<p>
Not a good sign, the free spirit thought to himself. </p>
<p>
It didn&#8217;t take long for Harrell to come to terms with reality.</p>
<p>
&#8220;I&#8217;m not cut out for cubicle life,&#8221; the U of I computer engineering major concluded. &#8220;I can&#8217;t be caged.&#8221; </p>
<p>
Barely six months after reporting for his first job in the real world, Harrell — then all of 23 years old — said good-bye to the workspace, farewell to the rules and regulations of corporate life and adios to the right to brag that he&#8217;d played a part in putting a state-of-the-art attack jet in the air.</p>
<p>
Instead, he set off on his own and settled into a new career &#8230; as a professional <a href="http://poker.prosportsonline.net"title="" >online poker</a> player.</p>
<p>
Before you jump to any conclusions about the folly of youth or the perils of immaturity, listen to what Harrell, now 26, has to say about his decision. </p>
<p>
&#8220;I&#8217;d saved up some money and I figured what better time is there to take a chance on something than when you&#8217;re young,&#8221; he said, sounding a lot older than 26. &#8220;I didn&#8217;t want to find myself sitting in a cubicle 20 years later asking myself, &#8216;What if?&#8217;&#8221; </p>
<p>
We&#8217;ll pause here to allow the 40-to-60 age group to vent a collective, regretful sigh.</p>
<p>
His friends thought Harrell&#8217;s move from cubicle to computerized card table was &#8220;cool, obviously.&#8221;</p>
<p>
His dad was &#8220;sort of OK with it.&#8221;</p>
<p>
His mother?</p>
<p>
&#8220;Worried sick,&#8221; Harrell recalled.</p>
<p>
She needn&#8217;t have been. </p>
<p>
<b>&#8216;WHY NOT ME?</b></p>
<p>
Emotionally and intellectually, Harrell had been preparing for the cyber poker universe since his sophomore year at Illinois.</p>
<p>
The catalyst: a dormitory hall mate who cleared $120,000 in an online tournament. </p>
<p>
&#8220;If he can do it, why not me?&#8221; Harrell asked himself.</p>
<p>
Why not indeed.</p>
<p>
Harrell — whose exposure to poker at that point was mostly limited to playing low-ante hands here and there with college buddies — became a student of the game. </p>
<p>
Juggling poker and studies, he came to appreciate that poker — when played at a certain level — is far from a recreational exercise. </p>
<p>
Approached seriously, Harrell points out, poker is a task blending math, psychology and strategy with a huge dose of self-discipline. </p>
<p>
Though Harrell won&#8217;t come right out and say it, Kenny Rogers nailed it. You really do have to know when to hold &#8216;em and when to fold &#8216;em.</p>
<p>
Even more importantly, said Harrell, &#8220;You have to be in control of your emotions. If I&#8217;m having a bad streak, I take off the rest of the day to clear my mind before I come back. And if I&#8217;m on a good streak, I know it&#8217;s going to end.&#8221;</p>
<p>
<b>5:30 P.M.-4 A.M.</b></p>
<p>
For Harrell, that day generally begins about 5:30 in the afternoon as the 9-to-5ers begin to drift home from their cubicles. </p>
<p>
Although many of the 100,000 or so players on an online poker site at any given time are seated before laptops and desktops in South Korea, Europe or South America, Harrell says the bulk of his competition comes from within the continental United States. </p>
<p>
He eschews tournament play as well as the high-stakes games that require &#8220;insane&#8221; antes of up to $100,000 for purses (and losses) that can total in the millions.</p>
<p>
Instead, Harrell favors mid-stake games with buy-ins between $400 and $1,000.</p>
<p>
Often juggling six games at a time, Harrell&#8217;s work routine goes something like this:</p>
<p>
Play for an hour or two. Take a break, maybe walk the dog. Play for another hour or two. Take another break, perhaps hang out with friends. Play for one or two more hours. Hit the sack about 4 a.m. </p>
<p>
&#8220;If you try to play six hours straight, your brain will fry,&#8221; he explains.</p>
<p>
Enough of the logistics, let&#8217;s get to the bottom line: Can you actually earn a living playing poker online?</p>
<p>
On his worst day, Harrell says, he lost $7,000. On his best day, he says, he won $10,000.</p>
<p>
Asked his actual income, Harrell was not what you&#8217;d call poker-faced: &#8220;I&#8217;m doing OK,&#8221; he smiled.</p>
<p>
OK enough to purchase a West County condo a couple of years back, keep up-to-date with Social Security and all the other taxes required of local, state and federal jurisdictions, cover the cost of his own health insurance, drive a fairly late-model car and — this is key — assuage the concerns of his mother. </p>
<p>
&#8220;When I didn&#8217;t go broke the first year, she realized I&#8217;d do OK,&#8221; Harrell said.</p>
<p>
Harrell may not miss the cubicle.</p>
<p>
But he does hanker for the academic life and doesn&#8217;t rule out one day returning to school for the graduate degree that could steer him into a potential second career as a teacher. </p>
<p>
For the time being, though, Harrell has no plans to fold &#8216;em.</p>
<p>
It&#8217;s a good life. He sets his own hours, reports to no one and is free to come and go to Miami, Seattle and sometimes, with buddies, Las Vegas.</p>
<p>
To be honest, Harrell is a tad ambivalent about visits to that last location. Nor is he terribly enthusiastic when friends suggest they while away a few hours at an area casino.</p>
<p>
&#8220;I&#8217;m not a big gambler,&#8221; he explained.

<p>  So lately I&#8217;ve been playing lots of hours on PokerStars.com in the $100-$200 NLH game.  I&#8217;ve been having so much fun with it!  In those games I&#8217;m regularly playing with only winning players.  From what I hear from a buddy who knows how to figure that stuff out, he tells me they are all big winners at NLH.  <br />  I&#8217;ve been trying hard and paying attention while I play, and while normally I get tired after like an hour, with my new glasses and interest in the game I&#8217;ve been putting in 6+ hour sessions&#8230; and I&#8217;ve been winning which makes it even more enjoyable.  Man, poker has changed so much, but I think it only takes a bit of learning and adjusting to the different fundamentals of today&#8217;s more advanced players.  <br />  My fundamentals, and the way I learned how to play the game was designed for very different kind of opponents and that approach is flawed against the players of today.  I grew up playing limit hold&#8217;em, a game where flop aggression is rewarded and thin value betting is a must.  It&#8217;s not much of a bluffing game at all.  <br />  I&#8217;ve been working hard on my no limit hold&#8217;em game and I&#8217;m happy with the results.  I feel I&#8217;ve become a lot more difficult to play against and have incorporated some things I&#8217;ve learned from watching some of the better online players.  I&#8217;ve learned a lot this week.<br />  Now, unfortunately none of this work is going to do too much to help my tournament game, as that&#8217;s a completely different animal, but that hasn&#8217;t been a concern of mine. I&#8217;ve been deep in every single event I&#8217;ve played this year and just need to get luckier in the late stages and that will translate into some wins.</p>
<p>*****************************************************************</p>
<p>  I spent only two days golfing due to my obsession with playing online of late.  I did find time to exercise and eat right, and I weighed myself before leaving for LA and was 153.6 lbs.  That&#8217;s 6 pounds less than I was when I got back from LA about three weeks ago.  I&#8217;ve been running, but also hadn&#8217;t had a sip of alcohol in three weeks.  The last two times I drank anything it was at the exact same restaurant and it wasn&#8217;t much, just two glasses of Pinot Grigio.  </p>
<p>  I hung out in LA yesterday since my flight overseas leaves out of LA.  I love flying Luftansa but desperately wished they had internet access on the planes.  They used to, and I know this because one of my Swedish friends took that flight overseas and played <a href="http://poker.prosportsonline.net"title="" >online poker</a> on the way in the hopes of paying for his flight.   Instead, he went off for 250k lol&#8230; now that&#8217;s an expensive flight!  </p>
<p>  This is going to be  long trip.  Austria for a week to play EPT Snowfest.  I hope to get some skiing in, haven&#8217;t done that since high school.  Then it&#8217;s off to London for a commercial shoot.  From there I&#8217;ll have a bit of time and plan on visiting my brother Mike and Ornella in Toronto for a few days before flying out to Mohegan Sun for the NAPT main event as well as the $25k Bounty Shootout.  The shootout will have a cap of 81 players, but unlike the inaugural event, it will not be an invitational.</p>
<p>  So lots of poker coming up, and then right after that we have the WPT Championship and the EPT Grand Final, two events I had on my &#8220;top ten list&#8221; of toughest tournaments (to fluke).</p>
<p>  In the meantime, I still plan on playing regularly in the $100-$200 NLH games at PokerStars.com&#8230; so come and get it! <img src='http://poker.prosportsonline.net/wp-includes/images/smilies/icon_smile.gif' alt=':-)' class='wp-smiley' /> </p>

			<content:encoded><![CDATA[<p>ESPN&#8217;s coverage of the <strong>2009 <a href="http://www.pokernewsdaily.com/articles/wsop/" title="World Series of Poker">World Series of Poker</a> (<a href="http://www.pokernewsdaily.com/articles/wsop/" title="WSOP">WSOP</a>)</strong> has been nominated for a <strong>Sports Emmy Award</strong> for the second consecutive year, as announced this week by the <strong>National Academy of Television Arts and Sciences</strong>. The broadcast, hosted by Lon McEachern and Norman Chad, is one of 54 nominations ESPN received this year – the most of any television outlet for the ninth time in the last ten years.</p>
<p>The nomination was for ESPN&#8217;s WSOP final table coverage in the category “Outstanding Live Event Turnaround.&#8221; The final table was played down to two players on Saturday, Nov. 7, and the heads-up match took place on Monday, Nov. 9. Viewers then tuned in to watch 21-year-old <strong><a href="http://www.pokernewsdaily.com/joe-cada-poker-player-profile-3437/" title="Joe Cada" rel="external">Joe Cada</a></strong> defeat <a href="http://www.pokernewsdaily.com/darvin-moon-poker-player-profile-3443/" title="Darvin Moon" rel="external">Darvin Moon</a> for the bracelet and $8.5 million on ESPN on Tuesday, Nov. 10 at 9:00 pm ET.</p>
<p>Also nominated in the category are ESPN2&#8217;s Bassmaster Classic, CBC/Versus&#8217; Tour de France coverage, Speed and NASCAR Media&#8217;s Inside the Headsets 25th All Star Race, and the PGA Tour&#8217;s Inside the PGA Tour Deutsche Bank Championship. The awards will be handed out on April 26 in New York City&#8217;s Frederick P. Rose Hall.</p>
<p>In 2009, ESPN&#8217;s WSOP coverage was nominated in the same category against ESPN2&#8217;s Bassmaster Classic, CBS&#8217; Tour de France, the PGA Tour&#8217;s Inside the PGA Tour Deutsche Bank Championship, and NBC&#8217;s Games of the XXIX Olympiad, which won the Sports Emmy. In all, NBC Sports won five Emmy&#8217;s for its coverage of the 2008 Beijing Summer Olympics.</p>
<p>ESPN&#8217;s newsmagazine, E:60, topped all 2010 competitors with seven nominations, including Best Edited Series and four nominees between the Short and Long Features categories. E:60 aired on ESPN the same night as the World Series of Poker, at 8:00 pm ET. ESPN&#8217;s Outside the Lines – winner of 11 Sports Emmy Awards in its history – received four nominations (Best Daily Studio Show, and three in the Long Feature category).</p>
<p>The 2010 World Series of Poker will get underway on Friday, May 28 with the inaugural Poker Player&#8217;s Championship. The event, which replaces the $50,000 H.O.R.S.E Championship, is a $50,000 buy-in 8-game tournament that will be televised by ESPN. The Player&#8217;s Championship will feature Limit Hold&#8217;em, Omaha Hi-Low Split-8 or Better, Seven Card Razz, Seven Card Stud, Seven Card Stud Hi Low Split-8 or Better, No-Limit Hold&#8217;em, Pot-Limit Omaha, and 2-7 Triple Draw Lowball. The winner will still receive the <a href="http://www.pokernewsdaily.com/chip-reese-poker-player-profile-453/" title="Chip Reese ">Chip Reese </a>memorial trophy.</p>
<p>While ESPN has not announced all of the events it will be broadcasting at the 2010 WSOP, it is assured that the network will again broadcast the Main Event, which begins on July 5, two days after the <strong>Ante Up for Africa</strong> charity tournament, which is also expected to be aired by ESPN. Like the past two years, the nine players who reach the Main Event final table will reconvene in November to play for the title.</p>
<p>The World Series of Poker and ESPN have a new seven-year broadcast agreement in place through the 2017 World Series. The new deal will begin in 2011, after the current broadcast deal expires.</p>

With<strong> Twitter</strong>, many of the elite in the game today allow their followers to keep tabs on them through their 140 character Tweets. <a href="http://poker.prosportsonline.net"title="" >Poker News</a> Daily monitors these chirps across the internet and brings you the best of what is going on.</p>
<p>Just like many people around the world, poker players leapt at the chance to celebrate<strong> St. Patrick&#8217;s Day</strong> on Wednesday. Whether it was pulling up a chair for some poker or pulling up a bar stool to tip a few, poker&#8217;s best kept up its end by celebrating well.<strong> Joe Reitman</strong>, who is in preparation for his Cinnabon bet, seemed to be torn as to what to do with the day, however. <em>“I&#8217;m an Irish-Jew, which means part of me wants to get hammered today &amp; the other part wants make me feel guilty for even thinking about it,”</em> Joe commented through Twitter. </p>
<p>Other members of the poker community had no such weighty decisions on their minds when it came to St. Paddy&#8217;s Day festivities.<em> “Gym then st pattys day drinking begins at 3pm. Counterproductive much?,”</em> tweeted<strong> Amit “amak316” Makhija</strong> as he started off his celebration. Recent <a href="http://www.pokernewsdaily.com/articles/wpt/" title="WPT">WPT</a> Invitational final table player<strong> Trishelle Cannatella</strong> hit Twitter to say she was a part of Amit&#8217;s celebratory party as they joined fellow poker players <strong>Adam “Roothlus” Levy</strong> and <strong><a href="http://www.pokernewsdaily.com/tiffany-michelle-159/" title="Tiffany Michelle">Tiffany Michelle</a></strong>, among others, in quaffing a few adult beverages. </p>
<p>Others in the poker world had issues that cropped up that didn&#8217;t have much to do with celebrating the holiday, however. <em>“Happy St Patrick&#8217;s Day,”</em> <a href="http://www.pokernewsdaily.com/vanessa-rousso-poker-player-profile-4076/" title="Vanessa Rousso">Vanessa Rousso</a> happily chirped on her Twitter account.<em> “Irony: my hairdresser accidentally turned my hair green&#8230;currently trying to fix&#8230;cross fingers for me!”</em> Another noted member of the poker community, WPT Live Tournament Reporter<strong> BJ Nemeth</strong>, tweeted, <em>“Didn&#8217;t do much to celebrate St. Patrick&#8217;s Day, but I am stopping for gas in Shamrock, Texas.” </em>Finally, poker player<strong> Rob Perelman</strong> seemed to be a bit of a Scrooge when it comes to St. Patrick&#8217;s Day when he tweeted,<em> “St. Patty&#8217;s Day is a pretty stupid holiday for someone who&#8217;s not a big drinker.”</em></p>
<p>Of note this week in Twitter was the announcement of the changes to the <strong><a href="http://www.pokernewsdaily.com/articles/wsop/" title="World Series of Poker">World Series of Poker</a>&#8217;s Tournament of Champions</strong>. After not being held for three years, the Tournament of Champions was resurrected this year with some unique twists. The TOC will have the fans choose who is part of the 27 player field by electing 20 <a href="http://www.pokernewsdaily.com/articles/wsop/" title="WSOP">WSOP</a> bracelet winners to play in the tournament. Poker players definitely were chirping about this new change soon after it was announced.</p>
<p>“That 70s Show” actor &#8211; and skilled poker player in his own right &#8211; Danny Masterson got on the bandwagon for one of his favorites. <em>“Poker buddies. WSOP tourny of champs. Top 20 make it…and vote for amigo <a href="http://www.pokernewsdaily.com/david-williams-55/" title="David Williams">David Williams</a>,”</em> Masterson tweeted. Williams was talking about the TOC and who he was choosing when he tweeted fellow pro<strong> Robert Mizrachi</strong>, <em>“I couldn&#8217;t vote for Grinder (only WSOP bracelet winners are eligible and <a href="http://www.pokernewsdaily.com/michael-mizrachi-–-poker-player-profile-488/" title="Michael Mizrachi">Michael Mizrachi</a> has yet to win one) and I gotta vote for at least one Mizrachi so you got it!”</em> Others who popped off on Twitter about the TOC included Hoyt Corkins, <strong><a href="http://www.pokernewsdaily.com/layne-flack-poker-player-profile-4128/" title="Layne Flack">Layne Flack</a></strong> and <a href="http://www.pokernewsdaily.com/gavin-smith-poker-player-profile-4119/" title="Gavin Smith">Gavin Smith</a>.</p>
<p><a href="http://www.pokernewsdaily.com/phil-hellmuth-66/" title="Phil Hellmuth">Phil Hellmuth</a>&#8217;s Tweets for the week demonstrated that Phil was either flying in exclusive company, or being a big name-dropper to anyone who would listen. <em>“At US premiere of &#8220;Bounty Hunter&#8221; in Manhattan,”</em> tweeted “The Poker Brat” on Tuesday about the new movie starring Jennifer Aniston and Gerard Butler. <em>“Said hi to Jen Aniston on the red carpet but don&#8217;t think she remembered me!!”</em> Hellmuth would go on to party the night away in NYC and tweet every step of the way.<em> “Abe and Arthurs CRAZY!! PACKED, @parishilton just walked in, and there 4 major models here: Anne V, Jess Gomes, Jess hart, Nicole trunfo,”</em> Phil commented about the nightlife. </p>
<p>A couple of days later, Phil was back at the same nightclub and reported that it was just as huge, tweeting,<em> “At Abe &amp; Arthurs-off hook again!! Jay Z &amp; Beyonce, Scarlet Johansen, Alan &amp; Robin Thicke, &amp; Russel Simmons in the house! J asked for lessons.” </em>Phil&#8217;s Tweets brought him a bit of razzing from friends, including “Hollywood” Dave Stann, who tweeted, <em>“I think you dropped something there, @phil_hellmuth&#8230; names, baby, names!” </em></p>
<p>Competing for the top Tweet of the week are two of the best when it comes to poker in Twitter and both had cinematic qualities. On one Tweet,<strong> <a href="http://www.pokernewsdaily.com/erik-seidel-poker-player-profile-454/" title="Erik Seidel">Erik Seidel</a></strong> noticed that the highly acclaimed Academy Award winning film “Avatar” was getting a revision, saying, <em>“For those who felt Avatar was too short Cameron has plans to rerelease the movie in theaters with added scenes. I don&#8217;t make this shit up.”</em> The second Tweet came from the legendary <strong><a href="http://www.pokernewsdaily.com/doyle-brunson-57/" title="Doyle Brunson">Doyle Brunson</a></strong>, who seemed to have some spare time on his hands. <em>“My wife Louise, along with Thelma our housekeeper, have gone to Hawaii for a week,”</em> Doyle quipped. <em>“Do u suppose Thelma and Louise will go for a little ride?”</em> referring to the climactic scene of the movie of the same name.</p>

			<content:encoded><![CDATA[<p>Recently, <a href="http://www.pokernewsdaily.com/articles/wsop/" title="World Series of Poker">World Series of Poker</a> (<a href="http://www.pokernewsdaily.com/articles/wsop/" title="WSOP">WSOP</a>) officials announced open voting to determine 20 of the 27 spots in the <strong>2010 Tournament of Champions</strong>. With five automatic qualifiers already in the field and two more left up to the event’s sponsor, <a href="http://poker.prosportsonline.net"title="" >Poker News</a> Daily staff writers cast their votes.</p>
<p>Each person can vote for up to 20 players and only former bracelet winners are eligible. Automatic entries include 2009 WSOP Main Event champion <a href="http://www.pokernewsdaily.com/joe-cada-poker-player-profile-3437/" title="Joe Cada" rel="external">Joe Cada</a>, 2009 WSOP Europe Main Event winner Barry Shulman, 2004 Tournament of Champions victor <a href="http://www.pokernewsdaily.com/anny-duke-51/" title="Annie Duke">Annie Duke</a>, 2005 Tournament of Champions winner <a href="http://www.pokernewsdaily.com/mike-matusow-poker-player-profile-463/" title="Mike Matusow">Mike Matusow</a>, and 2006 WSOP Tournament of Champions frontrunner <a href="http://www.pokernewsdaily.com/mike-sexton-poker-player-profile-483/" title="Mike Sexton">Mike Sexton</a>.</p>
<p><strong>Dan Cypra</strong></p>
<p>The 2010 Tournament of Champions will air on ESPN. As such, it’s important that the primary faces of poker appear in an All-Star Game. I cast my votes for the industry’s heavy-hitters, who first and foremost include four the most decorated bracelet winners: <a href="http://www.pokernewsdaily.com/phil-hellmuth-66/" title="Phil Hellmuth">Phil Hellmuth</a> (11 bracelets), <a href="http://www.pokernewsdaily.com/johnny-chan-124/" title="Johnny Chan">Johnny Chan</a> (10), <a href="http://www.pokernewsdaily.com/doyle-brunson-57/" title="Doyle Brunson">Doyle Brunson</a> (10), and 2010 National Heads-Up Poker Championship runner-up <a href="http://www.pokernewsdaily.com/erik-seidel-poker-player-profile-454/" title="Erik Seidel">Erik Seidel</a> (eight).</p>
<p>In addition, WSOP and WSOP Europe Main Event champs since the modern poker boom began should all receive invites, as they have truly served as the main faces of poker in recent years. Therefore, I selected <a href="http://www.pokernewsdaily.com/chris-moneymaker-poker-player-profile-4107/" title="Chris Moneymaker">Chris Moneymaker</a>, <a href="http://www.pokernewsdaily.com/greg-raymer-poker-player-profile-8014/" title="Greg Raymer">Greg Raymer</a>, <a href="http://www.pokernewsdaily.com/joe-hachem-104/" title="Joe Hachem">Joe Hachem</a>, <a href="http://www.pokernewsdaily.com/jamie-gold-poker-player-profile-4056/" title="Jamie Gold">Jamie Gold</a>, Jerry Yang, <a href="http://www.pokernewsdaily.com/peter-eastgate-166/" title="Peter Eastgate">Peter Eastgate</a>, Annette “<a href="http://www.pokernewsdaily.com/annette-obrestad-76/" title="Annette_15">Annette_15</a>” Obrestad, and <a href="http://www.pokernewsdaily.com/john-juanda-103/" title="John Juanda">John Juanda</a>.</p>
<p>I also picked the true powerhouses of poker. These players, while not Main Event champions or the top bracelet winners, exemplify what our industry is all about: <a href="http://www.pokernewsdaily.com/daniel-negreanu-48/" title="Daniel Negreanu">Daniel Negreanu</a>, <a href="http://www.pokernewsdaily.com/phil-ivey-169/" title="Phil Ivey">Phil Ivey</a>, <a href="http://www.pokernewsdaily.com/jennifer-harman-79/" title="Jennifer Harman">Jennifer Harman</a>, and <a href="http://www.pokernewsdaily.com/barry-greenstein-172/" title="Barry Greenstein">Barry Greenstein</a>. Finally, the industry’s internet guns should be represented. The top names in this category that I voted for were Jason Mercier, Brock “t soprano” Parker, Eric “basebaldy” Baldwin, and Phil “OMGClayAiken” Galfond.</p>
<p><strong>Sean Gibson</strong></p>
<p>I voted for Peter Eastgate, Joe Hachem, <a href="http://www.pokernewsdaily.com/allen-cunningham-49/" title="Allen Cunningham">Allen Cunningham</a>, Greg Raymer, Phil Hellmuth, <a href="http://poker.prosportsonline.net/2009/10/phil-ivey/"title="" >Phil Ivey</a>, <a href="http://www.pokernewsdaily.com/scotty-nguyen-poker-player-profile-515/" title="Scotty Nguyen">Scotty Nguyen</a>, Johnny Chan, Daniel Negreanu, John Juanda, <a href="http://www.pokernewsdaily.com/jeffrey-lisandro-poker-player-profiles-4081/" title="Jeffrey Lisandro">Jeffrey Lisandro</a>, Doyle Brunson, <a href="http://www.pokernewsdaily.com/erick-lindgren-65/" title="Erick Lindgren">Erick Lindgren</a>, Barry Greenstein, <a href="http://www.pokernewsdaily.com/annette-obrestad-76/" title="Annette Obrestad">Annette Obrestad</a>, Hoyt Corkins, <a href="http://www.pokernewsdaily.com/antonio-esfandiari-poker-player-profile-516/" title="Antonio Esfandiari">Antonio Esfandiari</a>, Erik Seidel, <a href="http://www.pokernewsdaily.com/chris-ferguson-47/" title="Chris Ferguson">Chris Ferguson</a>, and <a href="http://www.pokernewsdaily.com/huck-seed-poker-player-profile-462/" title="Huck Seed">Huck Seed</a>.</p>
<p>I voted for players based on a few criteria, but there was no absolute mathematical formula I had set. I first filtered by biggest money winners, but declined to pick players like Jamie Gold and Chris Moneymaker because, frankly, I didn&#8217;t think they could win. I then realized my main mental filter for picking players: &#8220;Could this person win this event,” which made picking the players a lot easier. There are a few players I left off on the bubble, but by and large, I felt that anyone in my list plays a current and relevant No Limit Hold&#8217;em tournament game and could take it down.</p>
<p><strong>Earl Burton</strong></p>
<p>I’m really glad that the WSOP allows fans to vote up to 20 players. It would have been close to impossible to limit it to just one, five, or ten. I also liked how the voting is limited to those who have won WSOP bracelets; it makes it a much stronger and more exclusive field than if anyone was eligible. Kudos to Harrah’s and the WSOP staff for bringing back the Tournament of Champions in this format.</p>
<p>I went with some of the usual suspects (Phil Hellmuth, Johnny Chan, Doyle Brunson, Erik Seidel, Phil <a href="http://poker.prosportsonline.net/2009/10/phil-ivey/"title="" >Ivey</a>, Allen Cunningham, Daniel Negreanu, Chris Ferguson, Barry Greenstein, <a href="http://www.pokernewsdaily.com/howard-lederer-77/" title="Howard Lederer">Howard Lederer</a>, and Scotty Nguyen) because of their success at the WSOP and their longevity in the game. I also believe that the previous year’s WSOP Player of the Year should get an automatic entry, so in this case I voted for Jeffrey Lisandro. I also voted for <a href="http://www.pokernewsdaily.com/tj-cloutier-121/" title="T.J. Cloutier">T.J. Cloutier</a> because he is regarded as one of the most successful tournament players in the history of poker and for John Juanda because of his championship at the WSOP Europe Main Event in 2008 and continued success in the game.</p>
<p>I also have some votes that I don’t believe will end up in the top 50 at the end of the voting process. Annie Duke cannot be the only female player in the game, so I voted for Barbara Enright (the only woman to ever make the WSOP Main Event final table), Jennifer Harman (the only woman to win multiple open WSOP bracelets), and <a href="http://www.pokernewsdaily.com/kathy-liebert-poker-player-profile-464/" title="Kathy Liebert">Kathy Liebert</a> (the all-time leading female money winner). Finally, I voted for Thor Hansen, who should be a lock for the Poker Hall of Fame or any All-Star tournament, and <a href="http://www.pokernewsdaily.com/mark-seif-125/" title="Mark Seif">Mark Seif</a> because I like Mark!</p>
<p>Although she would be a viable choice, Annette Obrestad shouldn’t merit a birth in this event. She has never been on the Las Vegas stage for the WSOP and, as such, let’s let her get some history in the Las Vegas version of the event before we bestow accolades on her. I also eliminated many “one-hit wonders” that seemingly have come and gone from the WSOP stage and have had little success in the game since their breakthrough.</p>
<p><strong>Maria del Mar</strong></p>
<p>My vote had to do with three main criteria. As Editor of Poker News Daily, I&#8217;m keen on players who make instant headlines, so I voted for Phil Ivey, Annette Obrestad, Barry Greenstein, and Chris Ferguson. Our readers are interested in anything these players do, as am I. Good headlines make this editor happy.</p>
<p>I&#8217;m all for women in poker, so I gave my vote to many female players. Besides Obrestad, I voted for Barbara Enright, a living poker legend; Jennifer Harman, whose charity work is as impressive as her poker skills; Linda Johnson, the First Lady of Poker and one of our beloved Guest Columnists; Vanessa Selbst and Kathy Liebert, who are shockingly not yet sponsored by any site; and Katja Thater. I wish I had Thater’s poker skills and I wish even more that I had her horses.</p>
<p>We all want good television, so I chose some players with a well-earned reputation for being incredibly entertaining at the tables. They included David &#8220;Devilfish&#8221; Ulliott; Dutch Boyd, my fellow Costa Rican Humberto &#8220;The Shark&#8221; Brenes, the dapper Sammy Farha, Carlos Mortensen, and of course Scotty Nguyen, baby!</p>
<p>As a bonus, I gave my last three votes to players I admire for various reasons: Allen Cunningham, one of the top players we never write about; Theo Jorgensen, who impressed me with his dignity after being knocked out of the first WSOP Europe Main Event; Chris Moneymaker because he is <a href="http://poker.prosportsonline.net"title="" >online poker</a>&#8217;s true hero; and Rafe Furst because I have learned something every day since I started following him on Twitter.</p>
<p><strong>Brett Collson</strong></p>
<p>Rather than selecting 20 deserving players who will almost certainly be voted in by fans (like Phil Ivey), I picked one player who might be overlooked by most voters: Matt “mattg1983” Graham. While covering the WSOP for the past two years, I developed an admiration for Graham&#8217;s commitment to poker. Like most of us, he began as a No Limit Hold&#8217;em player, but has made considerable progress in every variation of the game. The result: two WSOP bracelets in two years: Limit Hold&#8217;em in 2008 and Pot Limit Omaha in 2009.</p>
